Terms of Use

lo:live is an online platform for buying and selling space for promotional, brand and other experiential activity (the “Platform”). The Platform is operated by Location Live Limited (“Location Live” and “we”). These terms of use (the “Terms of Use”) apply to anyone accessing or using the Platform as a client (“you”).

You can access the Platform’s main marketplace at https://locationlive.com/lolive or from links contained on our website at https://locationlive.com.

You are currently accessing the Platform in a dedicated portal for Westfield Rise available at https://westfieldrise.locationlive.com. You can also access this portal from links contained on Westfield Rise’s website at https://westfieldrise.com.

By accessing or using any part of the Platform you accept these Terms of Use on behalf of yourself and your business.

If you operate a business as a sole trader, references in these Terms of Use to your business are references to you acting as a sole trader.

If you represent an organisation that does not operate as a business (for example, a charitable organisation), references in these Terms of Use to your business are references to such other organisation.

You do not need an account to access the Platform but you need an account to access and use many of the services on the Platform. You can sign up to the Platform and create an account for your business at https://locationlive.com/registration (our main marketplace) or at https://westfieldrise.locationlive.com/registration (the Westfield Rise portal). Once you have registered, your login will work on both the main marketplace and the Westfield Rise portal.

By signing up, you are registering your business as our client and engaging us to search for space for promotional, brand and other experiential activity on behalf of your business. You represent to us that you have authority to register your business as our client.

We grant you and your business a licence to access and use the Platform subject to these Terms of Use and any applicable law.

You agree not to download, reproduce, duplicate, copy or re-sell any part of the Platform.

We grant your business a licence to export content made available on the Platform for the sole purpose of producing materials for specific promotional campaigns for which you intend to buy space on the Platform. When exporting content for any specific campaign, you agree to only export the content your business requires for that campaign, as you consider appropriate for the identified geographic scope and date range of that campaign. You agree not to export content for general use or to re-use content exported for a specific campaign.

You agree not to export, download, reproduce, duplicate, copy or re-sell any content available on the Platform other than in accordance with these Terms of Use and any applicable law.

We may remove or reclaim a username if it violates any intellectual property rights or we do not in our sole discretion consider it to be an appropriate username.

We may suspend or close your account if you infringe these Terms of Use or access or use the Platform in any manner that we do not in our sole discretion consider to be acceptable.

These Terms of Use terminate when we close your account.

When you submit content to the Platform, you grant us a worldwide, non-exclusive, non-transferable and royalty-free licence to use the content on the Platform and in any advertising or promotional material for the Platform. You and your business indemnify us against any claims arising from any infringement of any third party intellectual property rights arising from your submission of content to the Platform.

We own or otherwise license all intellectual property rights in the Platform including (but not limited to) visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, and all other elements and components of the Platform. We reserve all of our rights in any intellectual property in the Platform.

Location Live and lo:live are trademarks of Location Live Limited. You agree not to use our trademarks without our prior consent.

Westfield Rise is a trademark of Unibail-Rodamco-Westfield. You agree not to use their trademark without their consent.

We often help businesses listing spaces on the Platform create and submit listing information for their spaces but we are not responsible for any published listing information. Neither we nor any business listing a space guarantee the accuracy of the listing information and neither we nor any business listing a space are liable for any inaccuracies or omissions in the listing information.

We exclude all representations and warranties (express or implied) to the fullest extent permitted by law.

We do not accept liability in any circumstances (including negligence) for: any indirect or consequential loss or damage; any loss of business or capital, profit, reputation or goodwill; or any loss of data or programs contained in or controlled by a machine.

Our liability for breach of contract or negligence is otherwise limited to £10,000.

Our limitation of liability does not limit or exclude our liability for death or personal injury.

We will try to resolve any disputes with you quickly and efficiently.

If you or your business want to take court proceedings against us, you agree on behalf of yourself and your business that you or your business (as applicable) will only do so in the courts of England and Wales. If your or your business’ circumstances entitle you or your business to rely on any legislation intended to enable you or your business to take court proceedings in the United States, you agree on behalf of yourself and your business that you or your business (as applicable) will only take court proceedings in the courts of England and Wales or the State of California.
